A well-intentioned records management or legal hold policy alone is not enough to improve a recordkeeping environment or to satisfy regulators or the courts. To assess and demonstrate how well its records management and legal hold programs are functioning, an organization must establish internal controls and audit for compliance. In this session we will focus on ways to measure if the program is working as designed. Control techniques and audit checklists will be presented.

Designing an Effective Records Retention Program

When creating an effective record retention program, the first tenet is to create a policy that is is descriptive and not aspirational. Incorporating appropriate policies and procedures to deal with legal holds and rising standards in this area is the second tenet. Kevin laid out the 1-2-3's of program design.
As counsel to the Complex Mass Torts/Insurance Litigation Department of Skadden, Arps, Kevin has a broad range of litigation and corporate experience. He has helped defend major insurance companies in environmental insurance coverage actions in numerous jurisdictions, has defended and advised clients in corporate, federal securities, insurance and environmental matters. He is Vice Chair of the Board of Bar Examiners of the Delaware Supreme Court, and a mediator and arbitrator in the Superior Court in Delaware; he is also active in the Delaware Bar Association.
